Terms of Service

These Terms of Service (“Terms”) govern your use of the SpendRebel application and website (the “Service”) operated by Chisel and Code LLC (“we,” “us,” or “our”). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the Service.

2. Description of Service

SpendRebel is a benefits tracking and reminder service designed to help users manage their Flexible Spending Account (FSA), Health Savings Account (HSA), and Dependent Care FSA (DCFSA) benefits. The Service provides:

  • Balance tracking and deadline monitoring
  • Smart notification reminders
  • FSA/HSA-eligible product search
  • Personalized spending recommendations
  • Receipt scanning and categorization
  • Tax reporting tools

3. User Accounts

To use the Service, you must create an account by providing a valid email address and password, or by signing in with Google. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to provide accurate and complete information when creating your account and to update your information as needed to keep it accurate.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Attempt to gain unauthorized access to any part of the Service or its systems
  • Interfere with or disrupt the Service or servers connected to the Service
  • Transmit any malware, viruses, or other harmful code
  • Scrape, crawl, or use automated means to access the Service without our permission
  • Impersonate any person or entity, or misrepresent your affiliation
  • Use the Service to collect personal information about other users

5. Intellectual Property

The Service, including its design, text, graphics, logos, icons, and software, is the property of Chisel and Code LLC and is protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our written consent.

You retain ownership of any data you input into the Service (account balances, receipts, etc.). You grant us a limited license to use this data solely to provide and improve the Service.

The Service provides general information about FSA/HSA/DCFSA benefits and eligible products. Nothing in the Service constitutes financial advice, tax advice, or professional financial planning. Not Tax Advice

While we provide tools to help track your benefits spending and generate reports, these tools are for informational purposes only. We do not provide tax preparation, tax filing, or tax advisory services. Always consult a qualified tax professional for tax-related decisions.

Product Eligibility

Our product eligibility information is provided as a general guide. Eligibility may vary by plan, employer, and individual circumstances. Always verify eligibility with your benefits administrator or plan provider before making purchases.

No Warranty

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

7. Limitation of Liability

To the maximum extent permitted by law, Chisel and Code LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

  • Your use of or inability to use the Service
  • Any errors, inaccuracies, or omissions in the Service's content
  • Unauthorized access to or use of our servers or any personal information stored therein
  • Any interruption or cessation of the Service
  • Any financial decisions you make based on information provided by the Service

Our total liability for all claims related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or $100, whichever is greater.

8. Termination

You may terminate your account at any time by deleting your account through the Settings page. We may suspend or terminate your account if you violate these Terms or if we determine that your use of the Service poses a risk to us or other users.

Upon termination, your right to use the Service immediately ceases. Data stored locally on your device will remain until you clear your browser data.

9. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the “Last updated” date. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the courts located in the State of Delaware.

11. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

12. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Chisel and Code LLC regarding the Service and supersede all prior agreements and understandings.
